AGC Publishes Guidance on New Davis-Bacon Rule (Oct 23)

The U.S. Department of Labor’s massive final rule “Updating the Davis-Bacon and Related Acts Regulations” takes effect on all new contracts awarded on and after October 23, with limited exceptions.

Contractors currently bidding contracts covered under Davis Bacon should consider changes to existing requirements as well as new ones.

The Financial Crimes Enforcement Network (FinCEN), in coordination with the Internal Revenue Service’s Criminal Investigation Division, issued a detailed notice urging U.S. financial institutions to take extra precautions to prevent the banking system from being used to facilitate a “concerning increase in state and federal payroll tax evasion and workers’ compensation insurance fraud in the U.S. residential and commercial real estate construction industries.”

DOL Makes Major Changes to Davis-Bacon Rules

Hesse Martone LogoOn August 8, 2023, the United States Department of Labor finally published its long-awaited Davis Bacon rule. The DOL’s 812 pages of rule justifications and explanations contain many substantial changes which will both expand the scope of work covered by Davis Bacon and which will change the way that the DOL administers the Act.

PBGC Approves $182 Million for Southwest Ohio Carpenters Plan

The Pension Benefit Guaranty Corporation (PBGC) announced the approval of an April 2019 application for Special Financial Assistance for the Southwest Ohio Carpenters Pension Plan covering 5,399 participants. The Southwest Ohio Plan will receive $182.6 million in Special Financial Assistance, including interest to the expected date of payment to the plan.

The U.S. Department of Labor (DOL) released its 812-page pre-publication version of the final rule to modernize Davis-Bacon prevailing wage that SWACCA has been engaged on dating back to the Biden presidential transition. The final rule represents the most sweeping overhaul of Davis-Bacon regulations since the Reagan Administration.
