Architects and Engineers Granted Lien Rights in Ohio

Effective as of September 21, 2021 Architects, Landscape Architects, Surveyors and Engineers have been granted the right to file liens against commercial real estate to secure payment that may be owed to them.
The listed design professionals will have lien rights if they have entered into a written contract with an “Owner” of commercial property to provide services with respect to a specific property. The written contract must have been signed by both the design professional and the owner. Only the design professional named in the contract (individual or company) will have the lien rights, and the lien rights do not extend to any employee, agent, or independent contractor of the design professional.
